Understanding copyright is critical for architects to protect their own work and to avoid liability for infringing on the copyrights of other architects. This presentation will give architects an overview of architectural copyright law and provide them with some fundamental tools that will help them navigate the complicated world of architectural copyrights.

Learning Objectives:

  • An architect will better understand key architectural copyright concepts—e.g., what is copyright, what is (and is not) protected by copyright, who owns it, how it can be transferred, and what statutes govern copyright.

  • An architect will be able to better avoid infringing on the copyrights of other architects by understanding concepts such as licenses, derivative works, fair use, and work for hire.

  • An architect will be able to better protect against copyright infringement through registration of the architect’s work and negotiating contract provisions that govern the architect’s copyright.

  • An architect will understand the basic elements of a copyright infringement action, and the potential damages available in such a lawsuit.

Presenters:

Jason Y. Chao is a trial attorney in Collins + Collin, LLP’s Orange County office. Mr. Chao’s practice primarily involves general business litigation, insurance coverage litigation, public entity liability, professional liability, civil rights, and employment law. Mr. Chao is actively involved in all phases of litigation, from pre-litigation counseling up to and through trial and appeal, at both the state and federal court level. His practice and experience also enable him to assist both his public entity and private clients with risk management, creative problem solving, and the development and implementation of strategies geared toward avoiding future litigation.

Paul A. Breucop is an attorney in Collins + Collins, LLP’s Orange County office. His practice focuses on construction law, including the representation of architects and engineers. He has substantial experience in all phases of litigation and arbitration. He is a member of AIA OC’s Committee on the Environment and presented to the AIA OC on issues of resiliency and sustainability from a legal perspective.
